Welcome to Dollar Cost Average. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully before using our services.

1. Service Description
Dollar Cost Average ("Service," "Platform," "we," "us," or "our") provides an automated dollar-cost averaging investment platform. The Service allows you to create recurring investment plans that automatically execute buy orders for stocks, ETFs, and cryptocurrencies on your behalf through our brokerage partner, Alpaca Securities LLC.
All securities transactions are executed through Alpaca Securities LLC, a registered broker-dealer and member of FINRA and SIPC. Dollar Cost Average itself is not a broker-dealer, investment adviser, or financial institution.
2. Eligibility
To use Dollar Cost Average, you must:
- Be at least 18 years of age;
- Be a legal resident of the United States;
- Have a valid SSN or ITIN;
- Be able to pass identity verification and KYC requirements as mandated by Alpaca Securities LLC;
- Not be a person barred from receiving investment services under the laws of the United States.
3. Account Requirements
3.1 Account Creation
You must create an account and complete the brokerage account opening process through our integration with Alpaca Securities LLC. This requires accurate personal and financial information, including your legal name, date of birth, SSN, residential address, employment status, and investment experience.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized access. We are not liable for loss or damage arising from failure to protect your credentials.
3.3 Account Accuracy
You agree to provide accurate, current, and complete information and to keep it updated. We reserve the right to suspend or terminate your account if information proves inaccurate, outdated, or incomplete.
4. Recurring Investments and Order Execution
4.1 Investment Creation
You may create recurring investments that specify a symbol (stock, ETF, or cryptocurrency), an investment amount, and a schedule (daily, weekly, biweekly, or monthly). Investments execute automatically on your chosen schedule.
4.2 Order Execution
Orders are submitted as market orders to Alpaca Securities LLC. We do not guarantee execution price. Market orders are subject to market conditions, liquidity, and applicable exchange rules.
4.3 Execution Failures
Orders may fail due to insufficient funds, market closures, trading halts, system outages, or other reasons. Failed orders may be retried automatically up to three times. We do not guarantee execution of any recurring investment.
5. Fees and Commissions
All portfolios — including automated DCA, Portfolio Autopilot, and Crash Accelerator — are free with no per-trade commission or subscription.
Additionally, uninvested cash in your brokerage account may be swept into FDIC-insured deposit accounts through Alpaca's cash sweep program. The platform may retain a spread on the interest earned on swept cash. The rate you receive may be lower than the bank rate.
The current fee schedule and detailed fee information are published on our Fee Schedule page. We reserve the right to change our fee structure with at least 30 days' prior notice. Execution fees are deducted at the time of execution and are non-refundable.
There are no fees for account creation, account maintenance, or account closure.
6. Investment Risks
Investing involves risk, including the possible loss of principal.
By using our Service, you acknowledge and accept:
- Market risk: Investment values may fluctuate and you may receive back less than invested.
- No guaranteed returns: Past performance does not guarantee future results. Dollar-cost averaging does not ensure profit.
- Cryptocurrency risk: Crypto markets are highly volatile and largely unregulated. Not protected by SIPC or FDIC.
- Liquidity risk: Some securities may be difficult to sell at a desired price.
- Technology risk: System outages or software bugs may prevent expected order execution.
Dollar Cost Average does not provide investment advice. You are solely responsible for your investment decisions.
7. Limitation of Liability
To the fullest extent permitted by law, Dollar Cost Average shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from:
- Your use of or inability to use the Service;
- Unauthorized access to or alteration of your data;
- Conduct of any third party on the Service, including Alpaca Securities LLC;
- Market losses, failed executions, or delays in order processing.
Total liability shall not exceed the total fees paid by you during the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless Dollar Cost Average and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Service, violation of these Terms, or violation of any third-party rights.
9. Modification of Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated at least 30 days before taking effect. Continued use after the effective date constitutes acceptance of the updated Terms.
10. Termination
You may terminate your account at any time by pausing all active plans and contacting us. We may terminate or suspend your account for any reason, including violation of these Terms, suspected fraud, or regulatory requirements.
Upon termination, all pending investments will be paused. Orders already submitted to Alpaca Securities LLC will be processed per their standard procedures. You remain responsible for fees incurred prior to termination.
11. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
11.1 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator in the State of Delaware or, at your election, remotely by videoconference or telephone. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
11.2 Class Action Waiver
You and Dollar Cost Average agree that any disputes will be resolved on an individual basis only. You waive any right to participate in a class action, class arbitration, or any other representative proceeding. The arbitrator may not consolidate more than one party's claims and may not preside over any form of representative or class proceeding.
11.3 Small Claims Exception
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdictional amount. If the claim is transferred or appealed beyond small claims court, the arbitration requirement applies.
11.4 Opt-Out Right
You may opt out of this arbitration and class action waiver provision by sending written notice to legal@dollarcostaverage.ai within 30 days of creating your account. Your notice must include your full name, email address, and a clear statement that you wish to opt out. If you opt out, all other provisions of these Terms remain in effect.
11.5 Brokerage Disputes
This arbitration provision governs disputes between you and Dollar Cost Average only. Disputes with Alpaca Securities LLC regarding your brokerage account are governed by Alpaca's Customer Agreement and applicable FINRA arbitration rules.
